Personal data  here means all information that relates to a person, not only unique information such as name and address, date of birth, but also indirectly personally identifiable information such as e-mail address, telephone number, mobile number, IP address, identifier, user ID, device identifier, browser data of a device that he/she has used, and other characteristics that express the physical, physiological, genetic, psychological, economic, cultural or social identity of this person and by means of which he or she can be identified. 

Anonymization means changing personal data in such a way that the individual details about personal or factual circumstances can no longer be assigned to a specific or identifiable natural person or can only be assigned with a disproportionate amount of time, cost and effort.

Service providers and “contract processors”:  We sometimes need other service providers to provide our services, who provide certain services on our behalf and process personal data according to instructions, such as hosting providers, software support services or marketing agencies for dialogue marketing. These are service providers who work on a contractual basis for a contract processing agreement, strictly in accordance with instructions and for a specific purpose, or, if these are merely ancillary services that do not constitute contract processing, are bound to comply with the technically and organizationally necessary measures to protect user data due to a data protection agreement. 

Processing  is any handling or use of personal data, whether or not by automated means. This means that any operation on personal data such as collection, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or any other form of provision, comparison or linking, restriction, erasure or destruction constitutes use of personal data.

Profiling  is any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

Controller or controller responsible for processing  is the natural or legal person, agency or other body which alone or jointly with others decides on the purposes and means of processing personal data. Where the purposes and means of such processing are specified by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

Recipient  is a natural or legal person, public authority, agency or other body to which personal data is disclosed, whether or not it is a third party. However, authorities which may receive personal data in the context of a particular investigation under Union or Member State law shall not be considered recipients. 

Third party  is a natural or legal person, public authority, agency or other body  other than  the data subject, controller, processor and persons authorised to process personal data under the direct responsibility of the controller or processor. 

Consent  Consent is any freely given, specific, informed and unambiguous indication of the data subject’s wishes in the form of a statement or other unambiguous confirmatory act by which the data subject signifies agreement to the processing of personal data concerning him or her.

Contact option via the website

Due to legal regulations, the website of ISUZU Sales Deutschland GmbH contains information that enables quick electronic contact with our company and direct communication with us, which also includes a general address for so-called electronic mail (email address). Purpose of data processing / legal basis 

ISUZU Sales Deutschland GmbH processes personal data in accordance with the provisions of the EU GDPR. The data is collected, used and processed exclusively to provide the website including its content and functions, to fulfill brochure orders, to carry out and process the test drive agreement or to create an offer, and to answer general contact inquiries. Unless we are expressly permitted to use the data for any other purpose, we only store, process and use the data to the extent and for as long as this is necessary to fulfill the respective inquiry.

The following legal bases apply to us for processing your data:

  • EU GDPR Art. 6 (1) a) allows us to process your data based on your consent for the purposes stated therein.
  • EU GDPR Art. 6 (1) b) covers data processing that is necessary for the performance of a contract as well as for pre-contractual measures, e.g. during a test drive
  • EU GDPR Art. 6 (1) c) allows us to process your data on the basis of a legal obligation, e.g. retention obligations under financial and tax law.
  • EU GDPR Art. 6 (1) f) allows us to process your personal data if we or a third party have legitimate interests in this processing and your interests, fundamental rights or freedoms are not opposed, e.g.:
    • Analysis of the use of our websites and creation of corresponding reports
    • Provision of service functions for website visitors
    • Avoiding damage and/or liability of the company through appropriate measures
    • Assertion, exercise or defense of legal claims

Access to the data

Depending on the purposes for which we collect your personal data, we may transfer or disclose it to the following categories of recipients, who will then process your personal data solely for those purposes:

a) Within our company and our dealer and workshop network:

  • our authorized employees,
  • our affiliated companies,
  • Members of our network of Authorised Dealers and Authorised Repairers that you have designated as preferred Authorised Dealers or Authorised Repairers, or who are located in your area (based on your postcode and address), or with whom you have had contact,

b) External business partners:

  • Service providers / contract processors: commissioned and bound by instructions service providers (contract data processors) receive personal data for these purposes if they offer a guarantee that suitable technical and organizational measures are implemented in such a way that the processing is carried out in accordance with the EU GDPR and ensures the protection of the rights of the data subject. Contact with authorized dealers and authorized workshops

If you purchase a vehicle or other product or service from one of our authorized dealers or authorized repairers, or if you provide or disclose personal information to them, you will have a separate relationship with that authorized dealer or authorized repairer. In this case, they will become the controller of your personal information, possibly jointly with us. If you have any questions or concerns regarding the processing of your personal information by one of the authorized dealers or authorized repairers, please contact them directly.

How is your preferred Authorized Dealer or Repairer identified? The preferred Authorized Dealer or Repairer is (1) the Authorized Dealer or Repairer you have selected as your preferred dealer or repairer or (2) if you have not made such a selection, is identified by us as the appropriate Authorized Dealer or Repairer based on location (the closest point of contact based on your zip code or address) or based on your history of contact with our network.

Storage and deletion of personal data  

The data we process is deleted or restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated in this data protection declaration, the data stored by us is deleted or anonymized as soon as it is no longer required for its intended purpose and there are no statutory retention periods that prevent deletion. If the data is not deleted because it is required for other legally permissible purposes, its processing will be restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons.

If you believe that, despite our efforts, there is a reason for a complaint against us, you as the data subject have the right to complain to a data protection supervisory authority. However, the data subject is welcome to contact us in advance to clarify any confusion or doubts. 

Social Plugins

To optimize our online offering, we have integrated so-called social plugins (“plugins”) on our website, Art. 6 Para. 1 lit. f GDPR. We use the data protection-safe Shariff buttons. This means that data is only transmitted to the operators of the social networks when you activate the plugins, such as the Facebook Share button, by clicking on the buttons.

When you visit our website on which plug-ins are installed, your browser may establish a direct connection to the servers of the respective provider (e.g. Facebook). This is because the content of the plug-in is transmitted directly to you or your device. During this process, data is transmitted to the provider, such as the information that your browser has accessed the corresponding page. This information, as well as your IP address, is then usually stored by the provider on a server in the USA. If you are a member of the respective platform and have logged in, the provider can assign the visit to our website to your profile.

If you interact with the plugin, for example if you click “share”, the information is transmitted directly to the provider and saved on the servers. This information is then saved and published on your Facebook profile.

YouTube

We use videos from YouTube on our website, which are made available on the internet platform www.youtube.de .

To embed videos on our website, we use the “YouTube” service of Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

By integrating YouTube into our website, we enable you to present various videos that you can watch directly on our website.

We use the extended data protection mode so that your IP address is not sent to YouTube when you visit our website with an embedded video and cookies are not stored on your computer. This means that your data is only saved by YouTube when you watch the video embedded on our website. As soon as you click on and play a video, personal data such as your IP address is collected and transmitted to YouTube.

We use “Vimeo” on our website to display videos. This is a service provided by Vimeo, LLC, 555 West 18th Street, New York, New York 10011, USA, hereinafter referred to as “Vimeo”.

Some of the user data is processed on Vimeo servers in the USA.

The legal basis is Art. 6 (1) (f) GDPR. Our legitimate interest lies in improving the quality of our website.

If you visit a page on our website in which a video is embedded, a connection to Vimeo’s servers in the USA will be established to display the video. For technical reasons, it is necessary for Vimeo to process your IP address. In addition, the date and time of your visit to our website will also be recorded.

If you are logged in to Vimeo at the same time as you visit one of our websites in which a Vimeo video is embedded, Vimeo may assign the information collected in this way to your personal user account there.
